ALTA 17 Series Access Endorsements Overview

The ALTA 17 & 17.1 endorsements provide that the insured lands abut and have vehicular and pedestrian access to and from either an identified street for the ALTA 17 or by way of an easement across land owned by another for the 17.1. The endorsement is most requested for commercial transactions where client, customer, or employee access are critical issues or for shopping center or multi-building complexes where access is by common driveways crossing numerous parcels before reaching the insured property.

The endorsements cover the street being open and maintained and that existing curb cuts may continue to be used. These facts are to be confirmed by the underwriter reviewing an on-line overhead view of the premises, a survey or filed maps.

The ALTA 17.2 is like the 17 or 17.1, but it insures that utilities have access, as opposed to vehicles or pedestrians. It doesn’t guarantee that existing utilities are in place, just that access rights exist. The New Jersey 17.2 is a variation of the ALTA form which has check boxes for specific types of utility services. In NJ, the 17.2 applies to all utilities. The 17.2 coverage is only available with a Loan Policy.

Access and Entry Endorsement

This endorsement, when affixed to a title insurance policy, provides assurances that the land abuts and has both vehicular and pedestrian access to a physically open and publicly maintained road, together with the right to use existing curb cuts to access same. The charge for the issuance of this endorsement shall be $50.00. In the case of simultaneously issued policies containing this endorsement, only a single $50.00 charge shall be made.

What you need to know:

The ALTA 17-06 provides assurance that the premises abut an open public street with access over existing curb cuts. It may be issued with either a Loan or an Owner’s policy.

This endorsement may be issued after verifying that the insured premises do have such access by examination of on-line overhead views, a survey, available filed maps or an actual inspection. Attention should be paid to any barriers to access including the possibility of the street and property being at different elevations. It would be unusual for the access endorsement to be requested when the premises are unimproved land.

Indirect Access and Entry Endorsement

This endorsement, when affixed to a title insurance policy, provides assurances that (i) the easement identified provides both actual vehicular and pedestrian access to and from an identified street to and from the insured parcel (ii) the identified street is physically open and publicly maintained, and (iii) the insured has a right to use existing curb cuts or entries along that portion of the identified street abutting the identified easement. The charge for the issuance of this endorsement shall be $50.00. In the case of simultaneously issued policies containing this endorsement, only a single $50.00 charge shall be made.

The ALTA 17.1 -06 provides assurance that the premises abut an easement that provides vehicular and pedestrian access to an open public street utilizing existing curb cuts. It may be issued with either a Loan or an Owner’s policy.

This endorsement may be issued after first searching the easement chain of title with attention to any limitations on use or obligations, such as maintenance costs imposed, and then verifying that the insured premises do have such access by examination of on-line overhead views, a survey, available filed maps or an actual inspection. Attention should be paid to any physical barriers to access including the possibility of the street and property being at different elevations. It would be unusual for the access endorsement to be requested when the premises are unimproved land.

Utility Access Endorsement

This endorsement, when affixed to a loan policy, insures against loss or damage by reason of the lack of a right of access to utilities, either over, under or upon rights-of-way or easements for the benefit of the Land insured, under certain enumerated circumstances. The charge for the issuance of this endorsement shall be $50.00.

What you need to know:

The ALTA 17.2 -06 provides lender assurances that the premises have a right of access to utility services over, under or upon a public right of way or easement without gaps or gores.

After verifying the existence of the easement and searching the easement chain for any limitations or verifying the existence of the public right of way, examination of recorded documents, an existing survey, filed maps or an overhead view should confirm utility service to the insured premises. Should confirmation not be readily ascertainable, independent confirmation that utility services exist should be obtained from the surveyor, utility company, municipal or county authority or an affidavit from the current owner.

This is a loan policy endorsement only. It is generally requested on premises with existing or recently completed improvements. If requested for unimproved land, please contact CATIC underwriting to review utility service verifications.
